1. About SeshTab and Acceptance of Terms

SeshTab ("the Service", "we", "us", "our") is a browser extension and web application for tab and session management, available at getseshtab.com and through browser extension marketplaces.

The Service is operated by Jakub Stolarski, conducting unregistered business activity (działalność nierejestrowana) under the laws of the Republic of Poland, pursuant to Article 5(1) of the Act of 6 March 2018 on Entrepreneurs' Law:

By installing the extension, creating an account, or using any part of the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

If you are a consumer (konsument) under Polish law — a natural person acting for purposes outside your trade, business, craft, or profession — additional mandatory consumer protections under Polish law apply and are not limited by these Terms.

2. Description of the Service

SeshTab offers two tiers:

Free Plan: Available without an account. Provides local tab and session management, up to 3 workspaces, up to 5 snoozed tabs, a command palette, and duplicate tab detection. All data is stored exclusively on your device.

Pro Plan ($4 USD per month): Requires an account. Includes everything in Free, plus: unlimited workspaces, unlimited snoozed tabs, cloud synchronisation across devices, AI Tab Clustering (powered by OpenAI gpt-4o-mini), full session history with 90-day retention, workspace profiles, idle tab suggestions, and priority support.

We reserve the right to change, update, or discontinue features of the Service at any time, with reasonable prior notice where material changes affect paid subscribers.

3. Account Registration and Security

To access cloud features or the Pro plan, you must create an account using a valid email address and password, or via Google or GitHub OAuth.

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately at support@getseshtab.com if you suspect unauthorised access

After creating an account, you may receive a short sequence of onboarding emails to help you get started with SeshTab. These emails are service-related and sent based on our legitimate interest in helping users discover the Service's features. You can unsubscribe at any time via the link in any email.

You must provide accurate and current information when registering. You may not create an account on behalf of another person without their authorisation, impersonate any person or entity, or use a disposable email address to circumvent account restrictions.

One person may maintain one account. Creating multiple accounts to circumvent plan limits is prohibited and may result in termination of all associated accounts.

4. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable law or regulation, including those of Poland and the European Union
• Infringe the intellectual property rights of any third party
• Transmit malware, viruses, or any harmful code through the Service
• Attempt to gain unauthorised access to any part of the Service, our infrastructure, or other users' accounts
• Reverse engineer, decompile, or disassemble the Service (except to the extent permitted by applicable law)
• Scrape, crawl, or extract data from the Service in an automated manner without our written consent
• Store or transmit content that is unlawful, obscene, defamatory, threatening, or that violates any third party's rights
• Use the AI Clustering feature to process tabs containing confidential client data, classified information, or data you are not authorised to share with third-party AI services
• Resell, sublicense, or otherwise commercially exploit the Service without our prior written permission

We reserve the right to investigate suspected violations and, where confirmed, to suspend or terminate accounts without prior notice.

5. Pro Subscription, Billing, and Renewal

Price and billing cycle

The Pro plan costs USD $4.00 per month. Subscriptions are billed monthly in advance on the same calendar day each month. All prices are displayed and charged in US Dollars.

Payment processing

All payments are processed by Stripe, Inc. By subscribing, you agree to Stripe's Terms of Service and authorise Stripe to charge your payment method on the recurring schedule described above. We do not store your full card details.

Automatic renewal

Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date. We will send you a payment receipt by email after each successful charge. The recurring nature of the subscription is disclosed at the point of purchase.

Failed payments

If a payment fails, Stripe will attempt to retry the charge. During a period of failed payments, access to Pro features may be suspended. If payment cannot be collected within a reasonable period, your subscription may be cancelled and your plan downgraded to Free.

Currency and taxes

Prices are in USD. As an unregistered business (działalność nierejestrowana) under Polish law, Jakub Stolarski is not a VAT payer and does not issue VAT invoices. Receipts confirming payment are provided by Stripe.

6. 14-Day Money-Back Guarantee

We offer a 14-day money-back guarantee for new Pro subscribers, subject to the following conditions:

• You must request a refund within 14 calendar days of your initial subscription payment
• The guarantee applies once per person and once per payment method; it does not apply to renewal charges
• To request a refund, email support@getseshtab.com with the subject "Refund Request" and a brief reason
• Approved refunds will be processed to the original payment method within 5–10 business days, subject to Stripe's processing timelines
• Upon refund processing, your account will be downgraded to the Free plan immediately

Statutory right of withdrawal under Polish law: If you are a consumer (konsument), you have the right to withdraw from a distance contract within 14 days of conclusion without giving any reason, pursuant to the Act of 30 May 2014 on Consumer Rights (Dz.U. 2014 poz. 827). However, by expressly requesting that we begin providing the digital service before the 14-day period has expired and acknowledging you will lose this right once service delivery has begun, that right may be waived. Our 14-day money-back guarantee provides broader protection than the statutory withdrawal right in any case.

7. Cancellation and Account Deletion

Cancelling your subscription

You may cancel your Pro subscription at any time through the Stripe billing portal, accessible via Settings → Billing → Manage subscription in the dashboard. Upon cancellation, your Pro access continues until the end of the current paid billing period. No partial refunds are issued for the remainder of a billing period after the 14-day guarantee period.

Effect of cancellation

After your Pro subscription ends, your account reverts to the Free plan. Cloud-synced data beyond Free plan limits will remain stored but may become inaccessible through the interface. We will retain this data for at least 60 days from cancellation to allow you to re-subscribe and recover it, after which we may delete it.

Account deletion

You may delete your account at any time from Settings → Delete account. Account deletion:

• Permanently removes all your cloud data from our database (workspaces, sessions, snoozed tabs, tab history, profile data)
• Immediately cancels any active Pro subscription (no refund for unused time, unless within the 14-day guarantee period)
• Cannot be undone
• Does not affect data stored locally in the browser extension (IndexedDB, browser.storage.local); you must clear that data through your browser's settings

Our right to suspend or terminate

We reserve the right to suspend or terminate your account for violation of these Terms, illegal activity, or abuse of the Service. We will provide reasonable notice before suspension except where immediate action is necessary to protect the Service or other users.

8. Intellectual Property

Your content

You retain full ownership of all content you create using the Service, including workspace names, saved tab URLs, and session data. By storing content in the Service, you grant us a limited, non-exclusive, royalty-free licence to store, transmit, and process that content solely to the extent necessary to provide the Service to you. We do not claim ownership of your data and will not use it for any purpose beyond operating the Service.

Our intellectual property

The SeshTab name, logo, software (including the browser extension and web application), website design, and all related documentation are owned by Jakub Stolarski and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works of any part of the Service without our prior written consent.

Feedback

If you submit feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free licence to use that feedback for any purpose without compensation to you.

9. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis.

To the maximum extent permitted by applicable Polish law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that data will not be lost due to technical failures, or that AI Clustering will produce accurate or complete groupings.

Important for consumers: Nothing in this section limits or excludes mandatory warranty rights available to you under Polish law, including rights under the Act of 30 May 2014 on Consumer Rights and the Polish Civil Code. Statutory rights are not affected by contractual disclaimers.

We strongly recommend maintaining your own local backups of important data and not relying solely on the Service for data preservation.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Jakub Stolarski shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, loss of goodwill, or business interruption resulting from your use of or inability to use the Service.

Mandatory consumer protections under Polish law: If you are a consumer (konsument) as defined by Article 22¹ of the Polish Civil Code, liability limitations that conflict with mandatory provisions of Polish consumer law are null and void to that extent. In particular, we do not exclude or limit liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of statutory consumer rights that cannot be limited by contract under Polish law.

Where liability is not excluded, our total aggregate liability for any claim arising from your use of the Service shall not exceed the greater of: (a) the total fees paid by you to us in the 3 months preceding the claim, or (b) USD $12.00.

11. Age Restrictions

You must be at least 13 years of age to use SeshTab. By using the Service, you represent that you are at least 13 years old.

If you are between 13 and the age of digital consent in your EU member state (which may be 14, 15, or 16 depending on your country), you represent that you have obtained verifiable parental or guardian consent to use the Service and to have your personal data processed as described in our Privacy Policy.

We do not knowingly collect personal data from children under 13. If we discover that a user is under 13, we will delete their account and associated data.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by sending an email to the address associated with your account at least 14 days before the new Terms take effect, and by updating the "Last updated" date on this page.

If you do not agree to the revised Terms, you must stop using the Service before the effective date. Your continued use after that date constitutes acceptance of the revised Terms. For non-material changes (such as clarifications), we may update the Terms without prior email notice.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions.

For consumers: If you are a consumer under Polish law, you additionally benefit from the mandatory consumer protection provisions of your country of habitual residence within the EU. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr for disputes related to online purchases. Our email for ODR purposes is support@getseshtab.com.

Any disputes shall be subject to the jurisdiction of the competent courts of Poland. As a consumer, you may also bring proceedings before the courts of your place of domicile.

Out-of-court resolution (Poland): As a consumer in Poland, you may refer disputes to: Inspekcja Handlowa (Trade Inspection), the permanent consumer arbitration court (stały polubowny sąd konsumencki) attached to a Provincial Inspectorate of Trade Inspection, or a district or municipal consumer ombudsman (miejski/powiatowy rzecznik konsumentów).

14. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the Service.

Severability: If any provision of these Terms is held to be invalid or unenforceable, it shall be modified to the minimum extent necessary to make it valid, and the remaining provisions shall continue in full force.

No Waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.
